Beyond impasse: how medical mediation can support health & care lawyers

by Arabella Tresilian, MMF Mediator and TrainerArabella Tresilian

In the arena of health and care law, disputes are rarely just about legal principle. The challenge for lawyers and legal teams often lies in navigating the tension between clinical realities, statutory duties and the values of patients and their families. At times of immense distress, even the most robust legal arguments can struggle to bridge the gap between parties.

In response to recent feedback from the legal community, and reflecting on the growing body of academic research, The Medical Mediation Foundation (MMF) has developed a suite of new resources specifically for legal practitioners.

Resources for legal practitioners

This includes a dedicated webpage for health and care lawyers, providing a clear overview of our process - from the initial scoping call to the conclusion of joint meetings.

We have also produced a downloadable Guide and FAQ sheet. This offers concise information on confidentiality, the ‘without prejudice’ status of discussions and how mediation can be tailored to meet the specific needs of your case.

Our aim is to support you in achieving sustainable, lawful and compassionate outcomes, preserving the vital relationships that must often endure long after the legal dispute has been resolved.
